By accessing or using the CreatorAtlas platform ("Service"), operated by CreatorAtlas, Inc. ("CreatorAtlas," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

CreatorAtlas is a TikTok Shop intelligence platform that provides market analytics, content performance insights, creative angle recommendations, and content licensing tools for creators and brands. We aggregate and analyze publicly available data and user-connected account data to deliver actionable intelligence. Features and functionality may change over time as we improve and expand the platform.

3. User Accounts

When you create an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be compromised.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Scrape, crawl, or use automated means to access the Service beyond its intended use.

5. Subscriptions & Payments

• All fees are non-refundable except as required by law or as stated in our refund policy.
• We may change subscription pricing with at least 30 days' advance notice.

6. Intellectual Property

The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of CreatorAtlas, Inc. and its licensors. Our trademarks, trade names, and branding may not be used without our prior written consent.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for the purpose of operating and providing the Service to you.

7. Content Licensing Features

CreatorAtlas facilitates content licensing agreements between creators and brands. We act as a platform to connect parties and are not a party to any licensing agreement between users. All licensing terms, compensation, and usage rights are negotiated directly between the creator and the brand. CreatorAtlas is not responsible for disputes arising from content licensing transactions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CreatorAtlas and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, or goodwill.
• Business interruption or commercial losses.
• Any damages arising from your use of or inability to use the Service.
• Any errors, inaccuracies, or omissions in the analytics or data provided.

Our total liability to you for any claims arising from the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. Analytics, insights, and recommendations provided by the platform are for informational purposes only and should not be construed as financial, legal, or professional advice.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease.
• We may delete your account and associated data after a reasonable retention period.
• You may request an export of your data before termination takes effect.
• Provisions that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last updated" date.
